Leading article: In defence of the judiciary

We have yet another indication that the Government is preparing for a battle with the judiciary.
Yesterday Lord Falconer warned that if the Government's anti-terror policies were blocked in the courts,
new legislation would be enacted to increase the pressure on judges.
This legislation would, we are told, "instruct" law lords on how to interpret the Human Rights Act.
They would be required to give the same weight in their assessment of cases to Britain's national security as the rights of individuals.

This relates directly to the Government's plan to deport Islamist extremists resident in Britain back to their home countries,
despite the fact that most of these countries in question have a shameful history of torture.
Such deportations have been illegal until now since article 3 of the Human Rights Act prohibits torture.
But the Government claims to have got round this by obtaining requesting guarantees from countries
such as Jordan and Algeria that anyone deported will not be subjected to inhuman treatment.
