Texas Gov. Rick Perry

granted a rare stay of execution

to a Houston woman just hours before

she was scheduled to die

on December 1, 2004

by lethal injection

for the 1987 murder

of her husband and two children.

 

Frances Newton has protested her innocence

since she was charged in the shooting deaths

of her husband Adrian, 23, son Alton, 7,

and daughter Farrah, 21 months,

in what prosecutors said was an attempt

to collect $100,000 from life insurance policies

on her family.

Section 7.02

of the Texas Penal Code outlines the following:

A person is criminally responsible

for an offense committed by the conduct of another

if "acting with intent to promote or assist

the commission of the offense he solicits,

encourages, directs, aids or attempts

to aid the other persons to commit the offense"

or 

"If, in the attempt to carry out

a conspiracy to commit one felony,

another felony is committed by one of the conspirators,

all conspirators are guilty of the felony actually committed,

though having no intent to commit it,

if the offense was committed

in furtherance of the unlawful purpose

and was one that should have been anticipated

as a result of the carrying out of the conspiracy."

 

Article 37.071(b)(2) of the Code of Criminal Procedures

permits the infliction of the death penalty

only if the jury believes beyond a reasonable doubt

that the defendant

"intended to kill the deceased or another or anticipated

that a human life would be taken."

Ms. McCarthy

was convicted and sentenced in Dallas County, Texas

where the prosecutor’s office has a well-documented history

of intentional discrimination going back to the 19th century.

 

Calling it history, though,

misrepresents the reality.

 

The discrimination has continued,

on a modern foundation of deliberate bias.

 

In 1963,

a manual of the office instructed that prosecutors

should not take “Jews, Negroes, Dagos, Mexicans,

or a member of any minority race on a jury,

no matter how rich or how well educated.”

 

In 1986,

the Dallas Morning News

reported that county prosecutors

were still trying to keep almost all blacks

off juries by using peremptory challenges.

Suzanne Basso

became the fourteenth woman

to be executed in the US in the modern era

after a last-minute appeal to the Supreme Court

failed on Wednesday (February 5th).

 

The 59-year-old former seamstress

was put to death by lethal injection

at the Texas state penitentiary

in Huntsville, near Houston.

 

She is the 510th person

to be executed in Texas,

the nation's most-active death penalty state,

since America restored the death penalty

in 1976.

 

Of those, 505 were men.

the nation's busiest death penalty state,

496 of them in Texas.

Virginia is a distant second,
